The lawsuit was filed Thursday in U.S. District Court in New Jersey and claims Wal-Mart driver Kevin Roper was “negligent” when he rammed into Morgan’s limousine bus.
“We’re cooperating fully in the ongoing investigation,” Wal-Mart’s Director of National Media Relations said in a statement. “We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved.“
Morgan’s 62-year-old mentor James “Jimmy Mack” McNair was killed in the crash. Comedians Ardley Fuqua and Jeffrey and Krista Millea, who were also passengers in the limo, are named as plaintiffs.
Roper has pleaded not guilty to death by auto.
